TerraSprout Terms of Use

1. Who we are, and what these terms cover
TerraSprout is a gardening app made and run by Dee Terry, doing business as TerraSprout. There is no company: "we" and "us" in these terms mean Dee Terry personally. These terms are an agreement between you and us about using the app.
The market has its own separate rules, in the TerraSprout Market Terms of Use. Where the two disagree about the market, the market's rules win. How we handle information is in the Privacy Policy.
By using TerraSprout you accept these terms. If you do not accept them, please delete the app.
2. Who can use TerraSprout
- TerraSprout is made for growers aged 6 and up.
- When the app is set up it asks the year the grower was born. For anyone under 13 it runs in child mode: AI help, the phone's GPS, the market and error reports are off, and a grown-up sets a 4-digit code that is needed to change it.
- The market is for people 18 and over, and signing up asks you to confirm it.
- Family sync is set up by a grown-up. A phone being used by an under-13 does not sync, and a child's own phone cannot join a family garden.
- If you are under 18, please use TerraSprout with a parent or guardian's agreement.
3. What TerraSprout is, and what it is not
TerraSprout works out planting dates, frost dates and care reminders from public weather records and from general horticultural rules. That is genuinely useful, and it is genuinely an estimate.
TerraSprout is not:
- a guarantee of any result, including that a crop will grow, survive a frost, or be ready by a particular date;
- professional advice — not agronomic, veterinary, medical, food-safety, legal or regulatory advice;
- a substitute for a soil test, an extension service, or a person who knows your ground;
- a record you can rely on for any legal or regulatory purpose;
- a source of advice on whether a plant is safe to eat, touch or give to animals or children. Some plants are toxic. Never eat or use a plant because TerraSprout named it.
Frost dates and forecasts are probabilities, worked out from past weather. The app says so where it shows them: a "safe planting date" is a date that was frost-free in nine years out of ten, not a promise about this year. Weather comes from Open-Meteo and can be wrong, late or unavailable.
You decide what to plant and when. TerraSprout informs that decision; it does not make it, and it does not take responsibility for it.
4. AI answers
Five features send something to an AI service (Anthropic, or OpenAI as a backup), and none of them until you have given permission: the advisor chat, a photo diagnosis, a photo check on a planting, seed-packet reading, and naming a plant from a photo. How much goes with it depends on which: the advisor chat carries the most — your climate, your setup, the weather, your plants and their ages, your beds and pots with the names and nicknames you gave them, your notes, and anything you have told the advisor before. A photo diagnosis or a photo check carries your climate, your setup and the current weather, and the one plant it is about — and, for a diagnosis, whatever you typed describing the problem. Not your other plantings, your beds, or the notes in your journal. Reading a seed packet carries the packet photo and the crop you are adding it to. Naming a plant from a photo carries the photograph and nothing about your garden.
- AI answers are generated, and they can be wrong, including confidently wrong. Treat them as a second opinion, never as an identification you act on without checking. This matters most for anything you intend to eat, and for anything toxic.
- Do not send other people's personal information, or photos of people, in a question.
- The AI services have their own terms, and we do not control what their models say.
- You can turn AI help off at any time in Settings → AI.
5. Your garden, backups and losing things
- Your garden lives on your phone. We cannot recover it for you: with family sync off we hold no copy at all, and with it on we hold only an encrypted one we have no key to (§6).
- TerraSprout makes backups on the phone and lets you save a copy elsewhere. Keeping a backup is your responsibility. If you lose your phone, delete the app, or the database becomes unreadable and you have no saved copy, the garden is gone and we cannot restore it.
- Installing an older version of the app after a newer one can make the database unreadable. The release notes say so when it applies.
- You keep ownership of everything you put into TerraSprout. You give us only what is needed to run the features you use.
6. Family gardens
- Family sync is off until a grown-up turns it on.
- It keeps one family garden in step across the phones in your own family. Everything is encrypted on your phone before it leaves it, and we hold no key, so we cannot read it and cannot restore it for you.
- Anyone whose phone is in the family garden can see and change what is in that garden. Personal gardens are not shared.
- A grown-up can remove a phone or delete the family garden from our service. Each phone keeps its own copy of the garden.
- We may stop the sync service, or change it, with notice in the app (§9). Your garden stays on your phone if we do.
7. Using TerraSprout fairly
Please do not: use TerraSprout to break the law; attack, overload or probe our services; work around the limits in the app, including child mode and the market's age rules; copy our services or content into another product; or pretend to be someone else.
We may stop serving a device or an account that does these things.
8. Other people's material, and ours
TerraSprout shows weather data from Open-Meteo, place names from Open-Meteo and BigDataCloud, and AI answers from Anthropic or OpenAI, each under their own terms and credited in the app.
The app itself — its crop information, its wording, its look and its code — is ours, and these terms do not give you any right to it beyond using the app. Everything you put into TerraSprout stays yours (§5).
9. Changes, and the app going away
TerraSprout costs nothing to use today, and if that ever changes we will say so in the app before it does. Features may change, and features may stop. We will say so in the app before a change that takes something away, and before the sync service stops. We may update these terms; if a change matters, the app will say so before it takes effect. Carrying on using TerraSprout after that means you accept the new terms.
10. No warranty
TerraSprout is provided "as is", without warranties of any kind, to the extent the law allows. We do not promise it will be available, uninterrupted, accurate, or fit for any particular purpose.
11. What we are not liable for
To the extent the law allows, we are not liable for:
- crops, plants, seeds or harvests lost, damaged or not grown;
- money spent or decisions made because of what TerraSprout said, including seed, plants, labor and equipment;
- illness, injury or harm from eating, touching or using a plant;
- garden data lost, including where no backup was saved;
- anything that happens between you and another person in the market, or in your family garden.
TerraSprout costs nothing to use, so if we are held liable despite the above, our total liability to you is limited to $50.
Nothing in these terms takes away rights you have under consumer law that cannot be signed away, and nothing excludes liability for death or personal injury caused by our negligence, or for fraud.
12. If you want to stop
Delete the app. If you have a market account, delete it in the app first, which removes your account, your listings and your messages. If you are in a family garden, a grown-up can remove your phone or delete the garden from our service.
13. Which law applies
TerraSprout can be used from anywhere, and growers are spread across many states. That does not change which law governs these terms: it has to be one state, because the states differ from each other and "the laws of every state" cannot be enforced. It is normally the state the operator is based in, not the state a grower lives in.
These terms are governed by the laws of New Jersey, and disputes belong to the courts of New Jersey. Wherever you live, the rights your own state's consumer law gives you and does not let you sign away still apply (§11).
14. Apple
You get TerraSprout through Apple's App Store, and Apple requires us to say:
- these terms are between you and us, not Apple;
- Apple is not responsible for TerraSprout or its content, and has no obligation to support or maintain it;
- if TerraSprout fails to conform to a warranty, you may tell Apple, and Apple may refund the purchase price, which is nothing today; beyond that refund, Apple has no other warranty obligation;
- Apple is not responsible for claims about TerraSprout, including product liability, any failure to meet a legal requirement, and consumer-protection or privacy claims;
- Apple and its subsidiaries may enforce these terms as a third-party beneficiary.
